The committal order emphasises that Dr. Clark and Mrs. Fulham arranged the details of the attack. Dr. Clark’s return to the house preceded the murder. He had prearranged a visit to Mrs. Fulham’s house, to which he went immediately after the murder. The Magistrate adds that IV. Clark Mrs. Fulham and Budhu were not charged regarding the poisoning. Despite good prima facie evidence of poison, it was doubtful whether the point could be tried jointly with the circumstances leading to tho actual attack.
