tPer Press Association.) Wellington, May 3. The Appeal Court delivered its reserved judgment this morning in the the case Pitcaithly v. McLean, appeal from the decision of Sir Robert Stout in an action arising out of a sub-con-tract for the supply of shingle, etc., for the Wellington Dock. The Court dismissed the appeal, upholding the decision of the Chief Justice that appellants had no right to damages, owing to no shingle having been ordered by respondent. Justice Sir Joshua Williams dissented from the judgment of Justices Edwards and Chapman. Costs were Plowed on the highest scale, and conditional leave of appeal to the Privy Council was granted.
