EMPLOYEES DISMISSED FOR MISCONDUCT
Appeal For Reinstatement Fails (P.A.) WELLINGTON, October 9. An appeal of considerable interest to employers and employees alike came before the Wellington Man-Power Industrial Committee when Denhard Bakeries Ltd. sought a reversal of the order of the district man-power officer requiring them to reinstate in their employ two female employees dismissed by them on the grounds of serious misconduct. Mr D. F. Lagan, assistant secretary of the New Zealand Employers’ Federation, who appeared in support of the appeal, said the appeal had been made on two grounds: first, that the decision of the man-power officer was against common law as affecting master and servant; and second, that the dismissals were fully justified by the conduct of the workers. Mr B. L. Hammond, a member of the committee: Do not the regulations abrogate common law? They state that such dismissals must be approved by the man-power officer. The committee ruled to that effect. After evidence had been heard on behalf of both parties the committee gave a decision reversing the order of the district man-power officer. The committee said it was due to the manpower officer to state that much of the evidence adduced before the committee was not known to him at the time of his decision.
