UNLAWFUL USE OF INSTRUMENT
Term Of Imprisonment (P.A.) DUNEDIN, October 8. A sentence of three years and six months hard labour was passed by Mr Justice Kennedy on Henri Arthur Hirt, aged 49, whose conviction on a charge of the unlawful use of an instrument was affirmed by the Appeal Court. The accused’s counsel, Mr C. G. White, said fresh evidence had come to light and in all probability an application would be made for a new trial. Hirt, he said, was born in Switzerland and studied medicine there. The Crown Prosecutor, Mr F. B. Adams: “The police have heard something of this new evidence and attach no importance to it whatsoever.” In passing sentence the Judge said: “Youi - action was no doubt the cause of the death of a misguided woman who sought your aid.”
