BANKRUPT BUILDER
FAILURE TO KEEP PROPER BOOKS

Leave to apply to the Appeal Court for a re-trial was granted Clarence William Bruce, builder, of Auckland, by Mr Justice Smith in judgment delivered at the Supreme Court.
At the present criminal sittings of the Court prisoner was found guilty of failing to keep proper books with intent to conceal the true state of his affairs and of failing to keep proper books within three years prior to his bankruptcy. When the verdict of the jury was returned accused’s counsel admitted that he could take no objection to the verdict on the second count, and on that issue prisoner was sentenced to three months’ imprisonment without hard labour. With regard to the first count, however, Mr Jordan moved for leave to appeal to the Court of Appeal for a new trial on the ground that the verdict was against the weight of the evidence.
