RESIDENT MAGISTRATE'S COURT.

(Before H. M'Culloch, Esq., R.M.). Fbidat, 21bt Mabch. John Donolly was charged with stealing £14 from the person of Peter Graham in Dee-street on the 18th inst. Mr Wade for the accused. The evidence was tedious and uasatisfacto-y, and the charge was dismissed. James Brown, alias Evans, was charged with stealing li spoons and 6 knives and forks from the Carrier's Arms Hotel. The evidence produced by the police for the prosecution seemed to be conclusive, and the accused was sentenced to 9ix weeks' imprisonment Mortimer HUhon, charged with allowing six horses to stray in the town, was fined 5s for each horse, and 6s 6 1 costs. Edward Huffadine was fined 10s and 6i 6d costs for allowing his chimney to take fire. Smith v. Alfred Kihan was fined 5s or 21 hours' imprisonment for bein? drunk an 1 disorderly in Dee-street on the 23 ' d inst. Alexander M Lennan was charged with violently assaulting James Stott, on Sun lay, 23rd inst., in his hause at One Tree Point : and also, at the same time and place, robbing him of £2. Mr Wade appeared for the accused. James Stott, settler at One Tree Point, stated that the accused was a neighbor of his. Oo Saturday witness was in town, and received £51 from Messrß Brogden and Sons. Paid it all away but two one poan I notes and some silver. Folded the notes in his pocket handk tied a knot upon it, and put i*. in his pocket. Went home, and on his way called at M'Lennan's with the newspaper. M'Lennan wanted witness to pay £1 which he said he owed him. Witness would not admit it was so much. It was for a boundary fence which had been repaired. Witness went home. On Sunday afternoon last witness was sitting reading in his own house between twelve and one o'olock. M'Lennan rode up to the door and caoie in, asking for the money. Witness told him to le»re the house. M'Lennan then struck witness violently on tho head with a whip-handle, knocking him down, and stunning him. He also kicked him on the side with his boot. He must have given two blows with the handle of the whip on the top of witness's head, there being two cuts, but witness only remembered one. When he came to himself he took his handkerchief to wipe away the blood that was running down his neck, and, opening it, found the notes *ere gone. The notes were in the handkerchief all right in the morning. Two neighbors, named Barclay and M'Kay, came to the house, and put witness to bed. A neighbor named Fisher came later. Told him he had been robbed. Cross-examined by Mr Wade. — Was quite sober at the time. Had no idea when M'Lennan came in that he was going to strike him (witness). Besides the two notes in the handkerchief had some silver in his trousers pocket, which was not disturbed. Could not say whether he told M'Kay and Barclay that he had baen robbed ; told Fisher. On ths application of tha police the accused was remanded for eight days, bail in the meantime being refused. Wisi v. Perkins. — This was a case set down for hearing in Dunedin, defendant's evidence being taken in Invercargill. The claim was for £3 Is, being £2 for advertising a half page in the New Zealand Directory, and £1 Is for a copy of the Directory. Defendant paid £2 into Court, and pleaded that it included the Directory, by agreement to that effect. Henry Mayo, called as a witness, preyed that defendant's agent bad made a similar arrangement with him. Wise v. Mayo. — Claim £4 4*, being a similar case to the above. £3 3s was paid into Court. Defence as in former case.
