RESIDENT MAGIST RATE'S COURT.
«i Before Henry M'CraiiOCH, Esq., E.M. Monday, Febbuabt 19th. ciyil cases. Vivian t. M'Callum.— Claim for £10, liquidated damages for breach of agreement. Mr Harvey for plaintiff. The evidence went to show that a contract of agreement had been entered into between the parties, whereby defendant bound himself to cut certain Burvey liuea in Seaward Bush under a penalty of £10 sterling. These lines, plaintiff contended, had not beea out in pursuance of the agreement. Defendant's evidence was to the effect that the lines had been properly cut, but that they had been to some extent destroyed by recent bush fires. The Court gave judgment for the sum claimed, with costs. Fairweather v. Fairweather. — Claim for £57. The case arose out of a number of disputed accounts between the parties. After evidence for the plaintiff had been heard, the case was adjourned for one week to enable defendant to file a set off. Rogers r. the Corporation of Invercargill.— Claim for £60 for compiling the Valuation 8011. Mr Wade for plaintiff, and Mr Macdonald for defendants. Plaintiff and two witnesses were examined at considerable length in support of the claim, after which the further hearing of the case was adjourned till this (Tuesday) morning.
