GABTHWAITE V. PUETTELKOW. Claim for £95 11s lOd .for smith's work done to the s.s. "Waihopai. Mr Macdonald appeared for Mr John Boss, the purchaser of the vessel, who had indemnified the defendant from all claims on account of the vessel. Mr Macdonald stated that the defendant had given Mr Hoss notice to defend the action, and he (Mr Macdonald) applied to have the account inspected by two competent persons who would report to the Court. ■ The plaintiff objected to recognise Mr Eoss in the matter, and the defendant being present in Court, acknowledged that the account was correct. Judgment was therefore given for the plaintiff with costs. Mr Macdonald wished the Court to notice that he had appeared on behalf of Mr Eoss, as it might be necessary in any future proceedings between Puettelkow and Eoss. SMITHS. PTJETTEIiKOW. Claim for £15 3s, for work done. Judgment confessed for amount with costs. JjAJSGt V. WILSOH". In this case the Eesident Magistrate gave judgment, and stated that the Bench were of opinion that the plaintiff had failed to show that the defendant had not supplied the number of cows agreed upon, and that the plaintiff was entitled to recover £11 10s from the defendant for loss of twenty-three acres of land.
