(Before H. M'Oulloch, Esq.; 8.M., D. M'Arthur, Esq., J.P., aad F. Nutter, Esq., J.P.) Civil Cases. LAING V. WILSON. This was an action brought by the plaintiff to recover from the defendant the sum at' £82 7s 4d, for damages and loss suffered by the plaintiff in consequence of defendant having failed to fulfil his part of a certain lease or agreement in writing for agricultural land and cows as follows: — Lease between John "Wilson and James Laing for dairy and agricultural land.—First to have at least twenty milch cows, and after the first year to have twenty-five ; to have the use of my dairy utensils, to be delivered at the end of the lease in good order • all improvements, as fencing stock-yard and houses, to be done betwixt us; to hare the use of horses for working on the farm, and all other implements in my possession for agriculture; term of lease five years, from and after the 10th April, 1862; one hundred pounds yearly sterling ; to be paid quarterly. The breaches of this agreement complained of by the plaintiff were that tha' defendant "had let portions of his land to other parties, thereby depriving him of the pasture alleged to have been let to him, and that defendant had not supplied to the plaintiff the number of cows specified. Mr Harvey appeared for the plaintiff. Mr Macdonald for the defendant. A number of witnesses were examined on both sides, whose evidence as usual in such cases was very contradictory, and after the counsel on both sides had addressed the Court, the Magistrates retired to consider their decision, but after remaining in consultation for some time the Eesident Magistrate intimated that the decision would be given at 2 o'clock the following day.
