Charles Freeman was charged with a breach of the Licensing Ordinance, 1335, for having on the 29fch ult., exposed for sale, a quantity of wine, and spirituous liquors, he not being a person duly licensed to sell liquors. Sergeant Shury deposed that on the 29th September, he went to the defendant's house at Waikivi, and there saw . the defendant's wife. He found the liquor produced behind the bar. The place was fitted np as a bar with counter on which stood decanters and glasses. "Witness seized the contents of the bar, which consisted of liquora, and the vessels containing them, and took them away. Sergeant O'Keeffe deposed that he accompanied last witness to defendant's house, and assisted in seizing the liquors produced. The defendant formerly had a license. The house was called the Waikivi Bush Hotel. The bar was fitted up in the usual way as an hotel bar. Witness went to the house in July last, and again in August last, when he saw defendant and cautioned him about his having no license. Defendant then said that he did not think it would pay him to take out a license, as he was going to leave the place. The defendant said he formerly had a license for the house, and the license had expired during his absence from home. Hehad no defence to make to the charge. The Resident Magistrate said the charge had been fully proved, and it was very necessary that persons who paid a heavy license should be protected. The law did not enable him to inflict fine or imprisonment ia this case, but required that on conviction the defendant should be fined not exceeding £50, and be imprisoned not exceeding four mouths. Ho should therefore inflict a comparatively light penalty — viz., £10, and five days imprisonment. In default of payment of the fin°, it would be levied by distress, and, in default of distress, 14 days' imprisonment. The liquor was ordered to be sold, and the proceeds paid into Court.
