Any person who shall commit any of the next folio '.v;;k; | offences shall on conviction pay to the person aggrieved, cpmpen-: - tion for or the value of the injury done to be assessed by tM.' adjudicating Justice to an amount not exceeding in any case Fifry Pounds and shall also be liable to the penalty and punishm,-.:' | hereinafter specified for the cases respectively:— : i 1. Any person destroying damaging polluting or. obstruct! v /; j any aqueduct dam sluice pipe pump .watercourse <>■•' fountain. 2. Or destroying or damaging any toll-bar toll-gate or otli.*:* public work used as a means for collecting any toil • r due. 3. Or damaging or destroying any- fenqe of whatev^: 1 description whether of wire iron wood or any ofh .•/ material or any wall stile or gate or any part thereor. 4. And any artificer workman journeyman or apprenticewilfully damaging spoiling^ _or destroying any jarooii .-; wares work or material committed to his care or ch.-ir.iiv. 5. And any person wilfully breaking any pane of glass i.i the window, of any building. 6. Or wilfully breaking or extinguishing or injuring :i ?.■;.■'• lamp. ..[....:■ 7. Or wilfully trespassing in any j)lace and neglecting " * refusing to leave such place after he shall have ]uv:T warned to do so by the owner or any person authorise! by or on behalf of the owner. 8. Or committing any injury or damage to any property whether private or public not hereinbefore provided i-> r the injury done being under the value of twenty pounds shall be liable to a penalty not exceeding Twenty Pounds or to imprisonment for a period not excee Ym-x three months : Provided that nothing hereinbef"».u contained shall extend to any case where the per^m offending acted under a fair and reasonable supposition that he had a right to do the act complained of nor in any trespass (not being wilful and malicious) commit! -d in hunting or the pursuit of game. 111. Whenever any credible witness shall prove upon oath before a Justice of the Peace that there is reasonable cause to sivpect that any of the articles of property hereinafter rnentioi (1 has been taken or stolen and is to be found in any house or oils-v place it shall be lawful for such Justice to issue a warrant -to seir-h such house or place for such property and any person in whn-e. possession or on whose premises' any of the said articles of proper y shall be found by virtue of any such search warrant (or by n> •' member of the Police Force when executing any warrant or o.tn rwise acting in the discharge of his duty) and who shall not snt'< ■■: the Justice before whom he shall be brought that he came lavWn ' - by the same or that the same was on his premises without .\s knowledge or assent shall on conviction of "any of the next folio vn: g offences be liable to the punishment hereinafter specified : — 1.
