“Of grave constitutional importance to His Majesty’s subjects in. England and in the overseas Dominions,” was how the Lord Chancellor, Lord Hailsham, described a case before the Judicial Committee of the Privy Council yesterday, which, allowed the appeal of a native" chief,. Esliugbayi Eleko, from the decision of the Supreme Court of Nigeria. The Acting-Governor had purported to make a deportation order' against the native chief, who then applied for leave to issue a writ of habeas corpus. The acting Chief Justice refused it. Eleko then applied to Mr Justice Tew, who also decided against him, and the Supreme Court uphold liis decision. Lord Hailshain said that, as judges had the jurisdiction to order a writ of habeas corpus, every judge to whom an application was ma,de must hear it on its merits, although some other judge had already refused a similar application.
