UNLICENSED HAWKERS.

ARRESTED POR DRUNKENNESS. Tavo motorists, Leo. .Mann and Tohn Martin, who have been hawking fruit around- the streets of OtaLi, wcic on Monday night arrested by Constable Satheriev, and yesterday morning the former appeared on four charges, viz., (IV Being drunk Avhile in charge of a motor-lorry; (2) Did fail to produce driver’s license where requested to do so; (3) Did drive an unregistered lorry; (41 Did hawk fruit Avithout a license. Mann was charged with, (1) Being drunk; (2), with hawking fruit \yithout a license. Both pleaded not guilty to being drunk, but guilty on all other charges. - q Dr. Milne, in giving evidence, stateu that he was -asked by Constable Satherlov to attend at the goal on Monday nio-ht. He arrived at 11.25, but he understood that the men had been arrested two hours previous y. When he examined them, however, ho found that thev were recovering from the effects of alcohol, but, obviously, controlled themselves Avith a view of appearing sober. They Avere fairly right when he examined them, but he could plainlv soe that they had had liquor, and by liis examination he came to the conclusion that they had indulged in alcohol for some days previous to then arrest. They were, at the time of examination. unsteady in their gait. Thomas E. Taylor stated that he A\as at the police station at 9.30 pan., Avhen Constable Sathcrley received a telephone message, and he asked hnnl (wi tnoss) to drive him down Mill Eoad, where it was reported that two motorists were in trouble. They found both men under the influence of liquor, and unfit to drive the lorry. Cvril Cobb gave corroborative evidence, adding that the lorry was in order, ami that he had no difficulty ni driving it: to Smith’s garage. Asked bv the accused if the gears were alright, witness replied that he did not have the slightest trouble wrh them. The back-wheels ot the loriy wore in the water-table but this made no difference to the driving. Constable Satherley said that ho found tlie tivo men under the influence ot liquor, and in consequence arrested them. They could certainly walk,_but their gait Avas very unsteady. They were unfit to drive a lorry, and were inclined to be cheeky. On the charge of being drunk Avhue in charge of a motor lorry Mann was lined £lO, being given four days in which to pay, in - default one month, while both Mann and Martin were lined £1 on each of the other charges, (ui default seven days), total, including witnesses’ expenses, of £l7 Is. Accused stated that the fines would bo paid the meantime the lorry, and fruit, would be left at Otald.
