CLAIM FOR DAMAGE TO MOTOR CYCLE.

At the Levin Magistrate’s Court last Thursday, before. Mr J. L. Stout, S-M-, Sunny Aranui, labourer, Mangahao, proceeded against Frank Burrell, Pub- , lie Works lorry driver for the sunt or £5 17s, damage to a motor cycle, allegedly caused through, defendant’s negligent-driving. Mr -A. M. Dunkley appeared for defendant, and Mr Moody for the plainPiaintiff, in, evidence, stated that he was four or five yards ■off on his correct side of the road, when he first saw the sorry. There was a sharp corner at. this place. He' was riding three feet front the bank. The lorry was brushing the bank all the way round , and was moving slowly. He did not think the 10rry_made any endeavour to avoid a collision. He had been struck by the hack wheel. No attempt had been made to pull tip, and the lorry driver had told him that the brakes were no good. Cross-examined plaintiff said he was familiar with the road and had expected to meet lorries on the trip. He had not heard or seen anything of the lorry previous to turning the corner where the collision occurred. He was travelling uphill, there being a bank on his left .and a drop of several hundred feet on the other side of the road which was 16 feet wide. There was -a sharp corner at the scene of the accident which he could not see round, as he approached. Defendant stated that he ccnald not have done anything to avoid the accident, The noise, of the engine prevented him hearing the approach of the motor cycle. It. (had been necessary to hug the corner in- order to get round the hair-pin bend. He had braked as quickly as he could. The Bench, in summing-up, said that the place where the accident occurred was obviously a bad corner and there was no "case of negligence proved. Defendant had done all he could to avoid the accident. He would give judgment for defendant, each to pay his own costs. ‘
