THE OHAU LAND CASE.

PLAINTIFF WITHDRAWS ALLEGATIONS. The civil action, Jacob Hpnry Lory v. Frederick Spencer Easton, in regard to the purchase of a farm property at Ohau, came to an unusual ending at the Supreme' Court at Wellington yesterday. Plaintiff based - his claim for damages, £4OOO under one head or £17,000 under an alternative head, chiefly upon the ground that the agents of the defendant had made certain misrepresentations as to the carrying capacity of the land to induce him to take over the property. Sir John Findlay, for the plaintiff, said the latter, after hearing the evidence produced, had now elected to accept a non-suit. The defendant, he said, had conceded that the plaintiff had acted in good faith in the matter. The plaintiff was satisfied that the defendant had not been guilty of any misrepresentation, and had acted m perfect good faith. Mr M. Myers, for the defendant, said that he had authority from his client to waive further action.

His Honour Mr Justice Salnjond said that the settlement was a proper one under the particular circumstances of the case. It Was evident that it was impossible lb rthe plaintiff to succeed in the action, and the agreement was a very proper one on the part of both, parties. m Mr Myers remarked that there was not in actual fact a settlement.

His Honour again remarked that the conduct of both parties was most satisfactory. By arrangement between the parties thei .Court made no order as to costs.
