The alleged dummyinm ease wm resumed this morning, when Alfred Trimble was re* called and gave evidence relative to Hendy’o signature in certain leases. Charles O’Hara Smith swore that he had been instructed by the Department to lay an information against Hendy. He remembered reporting on the charges against Hendy and Pease to the Minister of Lands, and had no objection to a copy of this report being produced. He bad lodged three other informations against Hendy, and would go on with the fourth even if the defendant wCre acquitted on the three. He had not the slightest personal feeling in the matter. He had received instructions to institute this strictest enquiry into all charges like the present. Mr Samuels, for defendant, urged that an information could net bo laid under the Land Act 1892, unless within a year of the com* mital of the offence; also that the defendant had been misled by the wrong declaration forms issued by the Land Department as to the amount of land an applicant could bold. The Resident Magistrate held that a prims fade case had been made oat against the defendant, and committed him to take his trial at the next session of the Snpreme Court. Bail was allowed, defendant in £250 and one surety in £250. Joseph Frederick Pease, o! Ha were, was charged with making a false declaration in respect of section 0, block $, Hawero. Defendant set forth in his declaration of 17th April, 1891, that he was not the owner of land more than was allowed by the Act, whereas in troth and in fact ho held land exceeding that amount. Davidson, storekeeper at Hawera, deposed that he took the declaration of the defendant as mentioned in the information. At thin the csss ww adjourned till fe.tawfl'oW.
