The murder case against Winiata lasted all day, and was adjourned till to-morrow, when Barlow, Clements, and an important witness who has turned up willjbo examined, and the case concluded, Mr Purdy appeared for the prosecution, ami Mr Dufauro for Winiata. The evidence taken to-day was that of Mr Cloghorn and his son, tin’s servant girl, Mrs Austin, Sergeant Green, and Dr Goldsboro. The details of the murder are already familiar to the public. John Smith, landlord of tiie Exchange Hotel, Auckland, but in 1876 landlord of the Royal Oak Hotel, Onehunga, gave fresh evidence not known at the Coroner’s inquest. He deposed to asking Winiata for money for' liquor which he owed him the. day before Packer’s murder, threatening to summon him. ‘ Winiata brought in in two hours’

time a pounl in gold on account. An hour afterwards Packer and Winiata came to the hotel, the former accusing the latter of stealing £2 19s from him, and paying £1 to Smith with part of it. Winiata denied the charge. They had angry words, and Packer left to lay an information to the police. Various witnesses deposed to meeting Winiata early on the morning of the murder in the Ecmuera district, and looking excited, and with blood on his deft thigh. He was enquiring the road to Oreki, and for a native named Brassey. Brassey was examined, but little could be made out of him, his answers being evasive though cautioned by the Bench. He could remember little or nothing be had said at the Coroner’s inquest, but said if he had a week to think over the matter he might possibly remember more. Mr Dufaure, the counsel for Winiata, did not cross-examine any other witnesses.
