AN IMPORTANT DECISION.
The compensation case in which Mr Robert Wilkin sought to recover from the Government compensation for injury by the washing away of his land on the Ashburton River, in consequence of the erection of the rail way bridge, &c, terminated yesterday. His Honor Judge Johnston presided at the Court, and gave the I'd lowing judgment:—The .Court arc unanimously of. opinion that some acceleration of the destruction of the claimant’s land has taken place in consequence of the works in que.-tion, but ns they are bound by section 38 of the Immigration and Public Works Act Amendment Act of 1871, they are obliged to come to the conclusion that the enhance ment of the value of the ad joining land, the property of the claimant, by the construction of the railway, is more than equivalent to the loss which he has sustained, and they therefore regret that they are bound to refuse the claim for compensation. Costs to be paid by the claimant, except the costs of the argument on the question of the law of limitation, which are to be paid by the respondent
