At the District Court, Hamilton, Mactavish brought an action against Ivess for alleged wrongful dismissal as editor of the 1; Waikato Mail.” £IOO damages were claimed. Defendant conducted his own case, and contended that the plaintiff had improperly suspended publication of the paper and reproduced old matter which had appeared in a previous issue of the “ Mail,” and that the plaintiff had insulted his customers, resulting in loss and damage to his business. Experts were called on both sides to prove the impropriety of such proceeding. Judge McDonald gave a verdict for plaintiff for £SO, remarking that (be defendant had conducted his case with great skill, and that it was a pity be did not bold a brief. Defendant gave notice of appeal.
