DISTRICT COURT.

TIMARU—THIS DAY. [Before His Honor Judge Ward.] CIVIL CASK. Green v. Kuubley.—Claim, £75 on a pz'omissory note. This case was unavoidably further adjourned. IN BANKRUPTCY. The following applications for orders of discharge were granted : lie C. W. Cowburn, a debtor, (Mr Hamersley.) lie John Wilson, a debtor (Mr Hamersley.) lie Jas Eedfern, a debtor, (Mr Jameson.) lie John Highley, a debtor. Mr Tosswill, on behalf of the trustee, applied that the debtor be compelled to deliver up posession of certain land. Mr Hamersley appeared to oppose the application. The land in question was a section originally belonging to Robert Scarf, of Timaru, but which was subsequently disposed of by him to Mrs Highley, who wanted the land to build a cottage on, and the transfer was to be made out in Mrs Highley’s name. Mr Jonas stated that this property had been assigned to him some time back. He did not know Highley in the transaction. Mr Hamersley contended that in the event of the land passing to the trustee, he would be obtaining property to which he was not entitled. He would be really taking money out of the hands of Mrs Usher, the mother of Mrs Highley, who had paid for this land, and to whom it actually belonged. His Honor discharged the order. The Court then adjourned.
