National Park Railways subdivision okayed

Railways' application for a subdivisional consent for a block of land adjacent to the railway line at National Park has been approved by the Ruapehu District Council Hearings Committee. The application was to subdivide the land to legalise an existing situation in that the land was leased to a third party, so needed separate titles for each lot. Many of the lots have existing houses and sub-tenants. Conditions attached to the approval included: □ Lot 1 ( tennis courts) be vested in council as a local purpose reserve. □ An area shown as "road to be stopped" be legally closed, with council carrying its cost and the applicant bearing the rest of the costs. □ An area shown as "to vest as road" (next to the railway line): be reconstructed to provide straight alignment and appropriate intersections with Fisher Road and Finlay Street; be 1 2 metres wide or where possible 1 5 metres wide to allow access by Railways to a communications cable; with kerb, channel and footpath on the eastern side of the street along the frontage from Fishers Road to the south

boundary of Lot 7. □ Appropriate stormwater management be provided and the sewerage system be extended and Lots 1 ,3,4,5,6,7,8 and 13 be connected to the sewer; all existing houses on Lots 5 and 7 to be connected to the sewer. □ Water mains be installed for Lots 5,6,7 and 8, plus Lots 9 and 10. Reasons given for the decision included: □ The committee did not believe that the Treaty of Waitangi claim (on the land) would be prejudiced. □ The committee acknowledged that the area is essentially urban. □ Concerns regarding boundaries (some submitters wanted the new legal boundaries to follow existing physical property boundaries) were best dealt with by the lessees and the owner. □ The committee believed the proposal was not contrary to the District Plan. With regard to the land use consent the committee said that the consent provided for an existing situation, and that any environmental effects would be minor.
