Queen's chain questions at council

The question of 'Esplanade Reserves' and Esplanade Strips ' was again debated by Ruapehu District councillors at its meeting in Taumarunui last week. Town planner Jane Whyte told councillors that the proposal before them was an "interim guideline" only until the next District Plan was adopted. (Details in last week's Bulletin). In answer to questions from councillors about what constitutes a river or stream as defined under the Resource Management Act 1993, she said that "a trickle becomes a stream or river when common sense and reason prevails".

Cr Stuart Shaw asked; "If the course of a river changes does the esplanade reserve change with it (as does an esplanade strip)?" When Ms Whyte replied "No", Cr Shaw said that it seemed an esplanade strip would therefore seem more valuable. Cr Bob Peck asked: "Does the Resource Management Act take precedence over the rights of the landowner in respect of Esplanade reserves?" Ms Whyte replied by saying: "Yes... but a landowner can appeal to the Planning Tribunal for a waiver".
