PENALTY FOR TRESPASS ON STATE FOREST
The State Forest Service (Mr. Roe), laid an information against the Leyland O'Brien Timber Company (Mr. Potter) in the Magistrate's Court yesterday for cutting timber on a forest reserve. The normal stumpage charge on ' the three trees rembved was £12, but counsel asked for a double royalty, plus appraisal expenses. The area concerned is State Forest No. 14, in the Opouti'hi Survey District. Mr. Potter said the company objected to the case being heard at Rotorua. Waihi would have been a more convenient venue, but the company could not hold uip its work to send witnesses to Rotorua. Counsel mentioned that the company had subsequently taken^ over the cutting rights on the area from which the trees were taken and it was not a'case of deliberate trespass. The magistrate, Mr. S. L. Pater'Son S.M., fixed the payment of royalty at the normal amount, £12, in addition to £5 6s. appraisal charges.
