CHARGED WITH RUNNING A LOTTERY IN BRITAIN

The magistrate held that he arbitrarily selected the beneficiaries of a scheme under which he •made offer of ,(sale of a chance that there might be prizes of which ■the purchaser might be given oue—! in other words the defendant admitted the offence of selling tickets in a lottery. The magistrate agreed to state a case for th'e High Court. The Duke of Atholl was charged at Bow Street Police Court on Novemher 14 with an alleged infringement of the Lotteries Act. This was the sequel to the distribution of money from the Duke's lottery fund. The prosecution hased the chaxge on a ticket sold to Arthur Chappel, of Bournemouth'. It admitted that apparently the Duke honestly helieved he had invented a method of evading | an' Act which had stood the test of 270 years. The Duke originally intended to run a sweepstake ou the St. Leger. He abandoned that plan, however, and later asked 1,000,000 people to subscribe 10s to charity, not promising to give any prizes, but •sug'gesting th'at it would kill the Irisl* sweqpstakes. Chappel said that decidedly he thought he was purchasing a chan.ce'. The Duke received £152,000 in reisponse to' his appeal. The prize-win-ners received £38,000, charities £59,000 and the expenses totalled £57;, 000 an aggregate of £154,000.
