JUSTICE HERDMAN ADJOURNS HEARING FOR A FORTNIGHT - MAYOR ADMITS ERROR

Auckland', Wednesday Following prolonged dissension in the Opotiki Borough Council, an application was made in the Supreme Court to-day by two councillors Messrs J. Anderson and S. Shalfoon for a writ to compel the Mayor, Mr. J. S. Moody to call a meeting and put the motion of which notice was given on July 13, namely: "That the town clerk, Mr. C. H. Fleming be and is hereby dismissed from his office as town clerk." When the case was called counsel for Mr. Moody said the mayor, believing he was acting according to the rules, had refused to put the motion, but he now agreed to do so as he had been advised that the view he took of the position was wrong. Counsel for the councillors, notwithstanding the mayor's undertaking asked that the writ be issued. Mr. Justice Herdman said: "If you have a promise from the defendant that he will do just what you want him to do, what on earth is the use of continuing this application? It is only a waste of time and money. What I propose to dc is to adjourn the matter." The hearing was adjourned for a fortnight. ______
