HIRE PURCHASE
WELLINGTON MAGISTRATE GIVES IMPORTANT RULING Wellington, Tuesday. Holding that certain eonditions of the hire purchase agreement used by Dominion Motors, Ltd., amounted to a penalty, and that the Court should grant relief, Mr. Page, S.M., in a reserved judgment, non-suited the company in an action claiming the full ; amount of outstanding promissory notes, £256 14s 9d, due on a car 1 handecl back. The company claimed that under the terms of the agreement it was entitled to the.Jull value of the outstanding promissory notes, plus interest and insurance. In noting that the car had been returned and that £345 had already been credited to the purchaser in part payment of a car bought for £741 14s 9d, Mr. Page remarked that the case was one of considerable importance and no little difficulty.
