COURT HQLDS ESTATE LIABLE FOR EMERGENCY TAX

Mr. Justice Ostler to-day in the case in which the executors and trustees of the will of the late George Dean Greenwood raised the question of whether they were liable to pay instalments of the unemployment emergency charge for which testator would have heen liable had he Iived. The testator died on August 28, 1932. Dufing the. year ended February 28, 1932, his income other th:a.n salary and wages was over £25,000. His Honour held that the executors were liable to the Crown for the two instalments unpaid of the tax on his 1932 income and for all former instaiments of tax on the income for the year ended March 31, 1933. His jionour said, however, that the questions involved were not fiee from diffieult'y, owing to the fact* that the answers dep ended upon the construction bf statutes which were enacted somewhat hastily to meet the p.resen•emergen'cy, and which iinposed f ox the first time a noyel form of taxatioh. The best construction he could give* to "the matter was that the contention of the Crown was c'orrect, altliough he should be happy to see the matter reeonsidered by the Gourt of Appeal.
