RACING APPEAL
SENTENCE UPON HECTOR GRAY IS NOT UPHELD Auckland Saturday. Judgment in the Dargaville racing appeal was delivered to-day. The judges said they were satisfied from the evidence of those who had observed the race and from evidence adduced that there' was a conspiracy to allow the horse Tetrachate to win the President's Handicap at Dargaville. , In the cases of R. A. Powell and C. R. Powell the district committee was in their opinion quite justified in concluding that the offence had been satisfactorily proved. In the case of H. E. Gray, the evidence against him was supported by consider.a,ble additional evidence which threw substantial doubt en the main evidence previously tendered and upon which his conviction was founded. "While we consider Gray's conduet is open to the gravest suspicion we feel that the case against him is not so clearly established as is reasonably requirad for so grave a charge and therefore his appeal sh'ould he allowed."
