PURCHASES. OF GOLD BY SECOND-HAND DEALERS

Wanganui, Thursday. In a reserved judgment of Mr. Justice Reed, delivered in the Supremo Court this afternoon, he upheld the appeal of John Walsh, deteetive, against the decision of Mr. J. H. Salmond, S.M., in respect of information laid by the poliee against a man deaiing in second-hand gold. The contention of the appellant was, if the decision of the Magistrate was correct. and people were allowed to purchase gold without a license under the Second-hand Dealers' Act, there would be faeilities to get rkl of ill-gotten gains. His Honour's judgment pointed out that the Act of 1908 is a eonsolidation of the Act of 1902. In ari iving at his decision to uphold the appeal, he reviewed two important seetions defining second-hand dealers, and pointed out that to be excluded from the operations of the Aet, the oniuis on the person to show he does not carry on the business of purchasing second-hand articles except for the purpose of inanufacturing articles from them. In this respect there was prima facie evidence that accused was a second-hand dealer without a license and did not furnish proof to show proof he was manufacturing articles from the gold he purchased.
