SLANDER CLAIM

RIVAL COUNTY COUNCILLORS FIGHT LEGAL BATTLE New Plymouth, Tuesday. Alfred Corkill, ex-chairman of the Inglewood County Gouncil, who was defeated at the last election, sued Robert Stuart, present chairman, for £125 damages, alleging that slanderous statements were made in the course of his campaign in opposition to plaintiff, both being candidates for the same riding. The claim was for £100 general damages, and £25 loss of office as county chairman. The statement of claim set out various statements alleged to be false and malicious. The first was that, plaintiff had taken couhty men off the road to do private work on his own privafte road, and that eight cases of county benzine had been given to the men to get them to and from his farm. Counsel for defendant indicated that the defence was firstly that the statements were not made as the .statement set out, and secondly any statements made were true and would be justified. Referring to some of these, counsel said that they were a fair comment and not libellous, and that in any case they were addressed to ratepayers and were elearly privileged.
