MURDER CHARGE

WHALLEY ON TRIAL FOR RECENT HERMITAGE KILLING

TIMARU, Tuesday. In the Supreme Court William John Thomas Whalley, married, aged 33 years, was charged with the murder of William Edwai'd Wogan at The Hermitage, Mount Cook, on November 5. The Crown Prosecutor reviewed the circumstances leading up to the charge. He said in cases of this type where a man is charged of murdering another, the jury no doubt would seek a motive. He did not pretend to have any strong motive to suggest, and where a man was on trial for his life it would be ill-becoming to build up theories concerning a motive. The only motive suggested from the evidence was a statement made hy accused to a 'bus driver two days prior to the tragedy, who would say that accused said: "If Bill asks you if you took any money down say yes," referi'ing to race transactions. Evidence for the Crown was not completed when the court rose at 5.45 p.m. The case- is expected to conclude to-inorrow.
