SOLICITOR EXONERATED OF FAILURE TO ACCOUNT.

AUCKLAND, Monday. A charge against Charles Stewart Leahy (44), solicitor, of receiving £29 5s by cheque and fraudulently omitting to pay same, thereby committing theft, was dismissed to-day, after a protracted hearing of evidence concerning mortgages. The magistrate said Leahy's conduct had been somewhat peculiar, but no criminal intent had been shown. There was no evidence to show that Leahy failed to account for money to the person named in the charge. The charge was laid on a private information. Counsel for accused said it was really a question of accounting between client and solicitor, and there had been considerable ill-feeling.
