WELLINGTON, Tuesday. The Chief Justice, Sir Michael Myers, in the Supreme Court to-day, heard an appeal hy Joseph Turner against his conviction and sentence of three months imprisonment imposed ©n him by the Magistrate, Mr. E. Page, on a charge of inciting lawlessness at a street meeting in Wellington on April 22. The assistant Crown Prosecutor said that in the course of his speech, accused had mentioned the Auckland riot and then nsed the following words: "There is .only op.e-quarter of an inch pane of glass between a hungry man and a full stomach. Necessity is the mother of invention. An empty stomach has no conscience. They acted in Auckland as they did because they were starving." Counsel for Turner said that it was unfortunate for Turner that the riot had occurred in Wellington some -time after he made the speech comnlained of. Sir Michael Myers said that it was still more unfortunate that police officers were present and took a note of what he said. The Chief Justice said the Magistrate was perfectly right in his judgment and the conviction must be affirmed. The appeal was dismissed with costs against appellant.
