In the claim of the Canterbury Wrestling Association against Tom Alley for £54 4s 2d damages for allqged bccaqh of contract in failing to meet McDougall at Christchurch on Novpmb'er 9, the Magistrate, Mr. McNeil, deeided in Alley 's favour. Alley admitted there was a contract, but contended that his physical condition was suqh that it was imppssihle for him to fulfil the contract. He produced a medical certificate showing that hq was suffering from bronchitis and influenza at the time. The Magistrate commented that he was bound to say he thonght Alley should hqve notified the Christchurch people earliqr than thq date of the contest that he would not be able to appear.
