HUNTER WILL CASE APPELANTS TO PAY COSTS

WELLINGTON, Thursday. The Court of Appeal this afternoon delivered judgment in the appeal of Cyril Paul Hunter and Charles Percy Hunter, trustees in the estate of the late Sir George Hunter, against the judgment of Mr. Jusice Reed delivered last April in the Hunter will case. The judment of the Court, prepared by the Chief Justice, Sir Michael Myers, and delivered by Mr. Justice Adams, was that the appeal should be dismissed with costs on the higher scale. In the course of his judgment his Honour said the onus of proving testementary capacity is upon the a'ppellant and the Court is unable to come to the conclusion that, in view of all the eircumstances of the case, they had succeeded in proving testamentary capacity, even on the date of the last codicil. The Court also held that as the appeal was prosecuted mainly in the interests of the two appellants, the costs must be paid by them personally.
