DESTRUCTION OF LOVING CUP INSTEAD OF ANOTHER HORSE OWNER ISSUES WRIT

AUCKLAND, Tuesday. A writ has been issued by Mr Mervyn Wells of Cambridge, against N. Austin, boiling down works proprietor, of Onehunga, claiming £700 damages for the loss of the race horse Loving Cup, which it is alleged was negligently destroyed. At the last Great Northern meeting, at Ellerslie, Glen Maree, which was also owned by Mr. Wells, ran f ourth in the Hunt Hurdles on the first day, but broke down badly in the Hunt. Cup on the second day. After obtaining veterinary advice it was decided to destroy Glen Maree and Mr Wells gave instructions to that effect. On the third day Loving Cup, after running second in the Orakei Hurdles was sent back to his stables, where Glen Maree also' was quartered. Later that day Loving Cup was destroyed instead of Glen Maree, and the action is the result.
