Per Press Association. Wellington. April 23. The Court of Appeal has commenced the hearing of the -case. Union Steamship 00. v. Wickes, , Ltd. A question of law arising out of the action was removed by order of Mr Justice Cooper from the '.J Supr-ma Court, Hokitika. Defend- I ants shipped on the Hawea at Grey- I month timber consigned to Launceston and AdrJanie. The defence was that the Hawtsi la-came a wreck, and, tliFrifore, ud freight was payable. A condition in the bill of lading under which the timber was shipped was that freight should be payable whether the ship was lost or not, but defendants alleged that the custom of plaintiff’s company was to collect freight at the end of each voyage.
