MARTON COURT.
WEDNESDAY, February 3rd. (Before Mr A. D. .Thomson; S.M.) At'the Magistrate’s Court, Marton, yesterday, an award was made> hy Mr A, D. Thomson, S.M., in the application of S. Stafford and T. W. Whittington for £3O compensation (funeral and medical expenses) from L. M, Taverner in respect to the death of T. H. Daw bin. The hearing of the claim was adjourned from December 9th to enable the evidence of Dr. Watson to be obtained, but in». the meantime respondent’s counsel admitted that Dawbin’s death resulted from accident in the course of' bis employment. Kis Worship disallowed as against the respondent an item in- the undertaker’s account, for re-opening tne coffin at the request of deceased’s relatives, and awarded £25 13s 6d compensation, £8 12s witnesses expenses, 6s ,Court costs, and £3 8s solicitor’s fee. Mr Collinsgappaered for the claimants and Mr Cook for respondent. Two actions for wages claimed by J. T. Boyle were heard. In the one’ action against J. Shapleske, Halcombe, plaintiff claimed 8 weeks’ wages at 30s weekly, and defendant counter claimed for £l7 14s for beard and lodging and cash advanced. The Magistrate disallowed both claim and counter-claim without costs. ' In the other action against Sbapleske and Wishnowskey, as road •contractors for Rangifcikei County Council, the plaintiff claimed £l3 16s and defendants contended that plaintiff’s ;olaim was liquidated by advances made and board-money. Defendant pleaded the Workmen’s Wages Protection Act; the contract being with a local authority, the exemptions in the Act did not apply. The Magistrate held that the Act in question did not apply to advance payments for wages and gave judgment for plaintiff for £7 16s 9cl without costs. Mr Collins appeared for plaintiff and Mr Graham, Feilding, for defendant in both cases.
