The bankrupt stated that up to '•October last year he t conducted a milk business at Feilding. At the beginning of that month his wife left Feilding with another man, and he found on investigation that she bad collected and taken with her, a 1 large amount of money due to him in connection with the business.- He sold his business to bis sister for £SO and applied the money in payment of various debts. Since that time he had been carrying on a canvassing business. He had instituted ■ x divorce proceedings against bis wife and she had sued him for return -;of ■* certain furniture which she claimed. She obtained judgment against him and later a judgment summons was taken out against him and he had no option hut to file His stock in - trade was estimated to be worth £lO and his debts to unsecured creditors i. ” T amounted to £lB9. ! ! In reply to questions by Mr ■ Graham, the debtor stated that the receipts during the past year from the van business were £443 18s 2d and ..the expenditure £9 15s more thau that r "\ sum. His receipts from the milk ■ t run had beeu £364 IGs, and there was J a credit balance of £lsl 15s Bd. This was what the books showed, i-2 but they had been kept by his wife. V’ Up to March last he had supposed ■\L_ bimself capable of paying ll the debts of tbe milk buisness from the van " -business. It was not until tbe judg- ? ment summons was taken out against him for £l7 that he had found himself in difficulties. He was still acting for Hall aud Co. iu the van business and held about £IOO worth of stock belonging to his employer. He was allowed one-third on the profit. 'Farther examination by Mr Gtaham was with the object of indicating that the milk .business bad not really been sold to the bankrupt’s sister and was still managed by the debtor. Mr Tolly proposed and Mr Bartholomew seconded, that the meeting confirm the resolution passed at the meeting ou the 12 th inst., expressing .dissatisfaction with bankrupt’s statement aud resolves that considering tbe unsatisfactory nature of the sale to bankrupt’s sister aud of bankrupt’s statements generally, it be a recommendation to the Official Assignee that bankrupt’s discharge be opposed until he pays his creditors 12s iu the £.
