Wellington, May 7. The Appeal Court , was engaged with the Nelson case" Moore v. Orford. The parties are medical practitioners. Applicant sold his practice at Richmond in 1905 to respondent, and agreed that he would not practise within eight miles of Richmond. In 1907 applicant went into partnership with two ocher medical practitioners in Nelson which was within eight miles of Richmond, and practised in Nelson for three months. The respondent Orford brought an action to recover liquidated, damages under applicant’s bond, and Judge Cooper entered np judgment for £3OO. This is an appeal from that decision.
