A DENTIST CLAIM.
Per Pre?s Association: Nelson, October 30. A case of interest to dentists ami their customers was hoard m tiie Magistrate's Court yesterday . Arthur Tattou, tiadiug as Tatton and bous in Nelson, now of Palmerston is., sued Peter Hunter, of Wamiea, fanner, for a set of artihcal teeth for Mrs Hunter. The defence was that a contract was mwlo for tlie snpply ; of a temporary sot of teeth till the <nuns shrank and hardened but a permanent sot to replace the former was never supplied, as Mrs Hunter s mouth needed an operation to lit it for the sett though some years elapsed. Through shrinking of tno gums the temporary. set was now practically valueless. The expert deuces of two dentists in Palmerstou for plaintiff and three iu Nelson for the defence went to show that the custom of various dentists -varied, some charging for actual work done and for temporary and permanent f.ets separately, while Tat ton's custom ! had been "to defer payment till a permanent set was suppliedi lhe Magistrate held that the contract was divisible and gavo judgment for three guineas for the temporary set. The actual balance! duo was 13s but as defendant had failed to pay the Ids into Court though lie had ottered it to-plaintiff's lawyer and it had been refused, costs of £3 lis were awarded. Other similar claims are pending with a similar defence.
