The High Court refused Mr'Vardon's application for a writ of mandamus for compelling the Governor of Australia to cause tho issue of a writ for a fresh election of Senator by the people. The Court held that the Governor of t.ie Statu was not an oflieor of tho Commonwealth, but refrained from expressing .-ui opinion on tho point raised whether or not a vacancy now existed for a a Senatorial representative of South Australia leaving tho Senate to settle the point itself.
