In addition to devises to testator’s wife and other persons, devise was made of testator’s interest in laud comprised in the Whawhakauga Block to Charles William Reardon. This devise was gufyjeot'to'the provision that within twelve months of the granting'of probate of the Wilt Reardon should pay all testator’s debts. The first application for probate was heard by Judge Butler, but he died without giving a decision. On the rehearing before Judge Palmer probate tyas re : fused on the ground that'the circumstances attendant upon the execution of the will were such as to cast upon it the suspicion that it was mot the last will of a free and capable testator, The Appellate Court toulay upheld the judgment of the Native Laud Court and dismissed the appeal,
