The case for the prosecution has closed. Mr Gleason, counsel for the defence, pleaded hereditary insanity, declaring that Thaw acted without malice and in self-defence, believing the threats made against him by White. The speech concluded with an appeal to the jury-to say would they not have done the same in his position, considering the stress and sense of wrong and hereditary taint.
