MAGISTRATE'S COURT.
Thursday's Sitting
Before Mr F. K. Hunt, S M
A I'AIUMAUOE BRAWL. That they committed a breach of the Peace, on November Bth, at Patumauoe, by using threatening behaviour, was denied by E. 0. N. Twidle, D A. N. Twidle, Mrs C Olsen, C. Olsen, J. Newton, Peter Arawanui and Sandy Maketi, when asked how they pleaded. The evidence submitted by both the prosecution (police) and the defence was very lengthy-too lengthy for our space at election time. The charge against Newton was withdrawn. In summing up, the Magistrate said there was no evidence against Mrs Olsen or E Twidle, but the mere fact of the latter holding his brother's coat disclesed that he was an accessory. The cases against these were dismissed.
The Magistrate said he would not favour one side more than the other. He convicted the two Maoris, Olsen and Twidle and imposed a fine of 40s in each case, the four to divide the costs of the action. SEQUEL TO COLLISION. PLMXTIFF AWARDED DAMAGES A claim was made by W. Taylor, against the Pukekohe Borough Council, for £52 18s fid, damages sustained to a motor cycle, personal' injury and shock, and inconvenience, caused through a collision with the Borough night soil cart, in West Street on April 10th the night of the liquor referendum. Mr 0 0. Mahoney appeared for plaintiff, and Mr Endean for the Borough Council. After hearing lengthy evidence, the Magistrate came to the conclusion that there was neligence on the part of the drivers of the cart because they left it standing without lights. He gav* judgment for plaintiff, for £35 8s 6d with costs.
