MAGISTRATE'S DECIBION
Further evilence was recently g v<<u in Auckland in the case partiallv liesnl st the last Papakura Court in which Mr Harold Hardwick Smith, of Prti»akura and late of Birkenhead, claimed from Mr T. J. Coiin, land agent, of Manurewa, the return of £33, which amount had been pa:d him in respect of commission on an exchange of plaintiff's farm at Birkenhead for a property at Papakura, owned by the late Mrs Daisy Coutts. The circumstances were unusual as the exchange had been agreed upon by the parties and the defendant rendered his account f >r commissfcn, which was paid, but before the wed of exchange was signed MrsOoutts died and as th« •state was practically insolvent her trustees refused to proceed with the transaction. The defendant (Mr Corin) contended that as far as he was concerned the exchange wa< completed. The Magistrate (Mr F. K. Hunt S M ) remarked that the defendant had acted in good faith but gave judgment for the plaintiff for the £33 with costs as the contract had not been completed.
The next sitting of the Papakura Magistrate's Court will be held on Friday. Among thencases set down for hearing is a charge in respect cf threatening behaviour, whilst two aliei 8, and a woman, are to he f ( , r failing; to" register Wlßrtie Aliens Act, lUI7 A case of diphtheria at;; Papakura was yesterday notified to the Health Department.
