BREACH OF PROMISE SEQUEL The sequel to a recent breach of promise case, in which the plaintifff lima Eileen Pegler, was awarded damages, came before Mr E. Page, S.M., in the Auckland Magistrate's Court last Friday when an unusual application was made by the plaintiff's solicitor, Mr Graham under the War Regulations. A recent War Regulation provided that in future no warrant of distress should ho issued or executed against the pro« perty of a soldier without the leavo of tlie Attorney-General, and tlmt such leave should bo granted only on the recommendation of tho Magistrate. Mr Graham applied for leave to issue process of execution against the property of George Thomas Coxhead, and to proceed to enforce the judgment -of the Supreme Court, ordering him to pay £2,' -Is lid to the plaintiff. George Thomas Coxhead said except for a few pounds he had no property. George Coxhead, sen., a farmer, of Manurewa, said he paid his son only a few shillings a week, but admitted thatjiis services were worth more. His son was managing a farm on small wages on the understanding that the farm would ultimately be transferred to him. Witness was not holding bafck the transfer in order to defeat the judgment. Mr Graham, in urging that the recommerdation should be granted, said Coxhead had led Miss Pegler to believe that ho owned the iarm, although it was not transferred to him.
The Magistrate said there was not sufficient grounds to warrant him making auy recommendation to the Attorney-General, as it wa9 clear Coxhead had no property. There was no merits in his position, and he would not be allowed costs.
