I w (See also pages I and -!). a ROAD DEDICATION QUESTION, r Tbe matter ot the dedication of c Henderson's road, Tuakau, reached ' another statre yesterday, when a * deputation of the Tuakau Town > Board, consisting of Messr" DyneH ' Fulton, W. Glasgow and H. Craig, waited on the Franklin County k Council relative to the Council's ? decision at its last meeting to accept dedication to the road. 1 The acting-chairman, Cr Lockwood, explained that when the plan for the road was first before the Council the road was under the Council's jurisdiction, but it had since passed into the control of the Town Board. The road, however, had been formed according to the c plan that was approved uf by the * Council at the time and accordingly t he considered that the Town Board was bound to accept dedication on « the plan as passed by the Council, t Mr Dynes Fulton contended that c although a plan cf the full road t was presented to the Council, of 1 which body he was at that time a t member, approval was only accorded \ ' to ;i action that was subsequently con -1" r <ir.t <-d ar 1 not to the lull length t of the road. f The County Eneinfer, Mr J. F. I produced the plan, which he said had met with his approval \ and wli;eh he understood was c parsed t y the Council as regards I the road in its entirety. E. At the request of Mr Fulton | reference was made to the minutes 1 ' of the Council's meeting when the j ' plans were submitted, vi/.., ,'f r December 17th. 1 !)!.*?, hut I lit- same f only showed that the Engineer in ' bis ordinary report recommended s the acceptance of the plan, no a
special resolution dealing therewith being recorded although the Engineer's pian was adopted. Mr Fulton again contended that only part of the road was then projected and that accordingly the Council's acceptance was confined to that particular portion. He explained that his Board refused to accept dedication of the road unless it was metalled. The acting-chairman was of opinion that as the engineer's report of December 17»h, 1913, concerned the plan tor the full road it was natural to assume that the whole ot it was approved of by the Council. Cr Motion stated that he was chairman of the Council at the time, and he believed that the fall road was accepted as shown on the plan. Mr Fulton asked it the Council would go against the Town Board if legal proceedings ensued. Tbe acting-chairman replied that it was not that the Council would oppose th2 Town Board, but they would simply have to support their engineer in regard to having approved ot tbe road. Mr Fulton produced the deed of dedication as forwarded to his Board by Mr Henderson's solicitors, and the acting-chairman mentioned that the matter now rested with the Town Board aa to what action to take, as the Board and not the Council had the deed before them. Hr Craig suggested that possibly in order to come to an amicable arrangement Mr Henderson might agree to metal a portion of the road. The deputation then withdrew, the acting-chairman giving a promise that it the Council was asked to sign tbe deed of dedication the Town Board would be communicated with before signatures were appended: Mr J.
