FRANKLIN COUNTY COUNCIL
Notice of Special Order.
Notice is hoieby given that at a special meeting ot the Franklin County Council held on the sth day of March, 1914, the following resolution was passed : The Frnnklin County Council hereby makes by special order the following By-Laws in pursuanco and exercise of authorities and powers vested in it in that behalf by the provisions of '"'Jhe Couuties Act, 1908," and its amendments and in pursuance and exercise of every other power and authority (if any) enabling it in that behalf. Ihe short title of the By-Laws is "The By-Laws of the Fianklin County." The object and purport of the said By-Laws is as follows : Tart I. Order cf Prcceedii.gs. Provides for Annual Meeting, appointment of Finance and Works, and other Committees and constitulions thereof; order of business ; voting at meetings : giving of notice of motion and moving same, and the ordtr in which same shall be received and dealt with; standing orders for regulating the debates at meetings, proposing, amending and withdrawing motions; ruling of Chairman on points of order and effect thereof; powers of Chairman ; Duty of Councillors to attend Council Meetings and the rights and powers of councillors; voting at meetings; Committees; calling meetings of same and recording proceedings thereof; the presentation of petitions and the contents and form thereof; duties of Councillors presenting same: The Election of Officers of the Council; advertising for applications; salary to be fixed and specified in advertisement ; security to be given in certain cases, and the expense of preparing same to be borne by person providing same ; public works; laying plans and specifications before the Council; ratepayers to have power to inspect; disbursement of moneys; procedure for authorising same ; only £lO 0s 0s to be disbursed between any two ordinary meetings. The County Seal and the custody thereof ; same shall only bo affixed in presence of Chairman and one Councillor ; or two Councillors in absence of Chairman.

| Part IX. Conservation of Public Health and Convenience; Cesspits I to be cleaned out, powers of Council ; to recover costs for cleaning same ; offensive matter not to be spilt or cast upon any road ; prescribing minimum distance of privy from road or dwelling; Council to grant licenses for removal of night-soil: only authorised persons to remove same ; householders to provide proper receptacles for privies and shall prevent any nuisance ; powers of Inspectors or other agent of Council to inspect condition of privies; swme not to be kept less than 40 feet from a dwelling nor wihia 100 feet of a public road. Part X. Cemeteries. Division of a cemetery into lots, only six luts to be acquired by any one person ; no peison allowed to transfer lot to another ; clerk- to keep record of lots sold : receipts for purchase money to be given. Burial warrant to be obtained eight hours before interment; presciibing forms of application for burial warrant, and certificate of purchase of burial plot, and fees for same. Burials permitted only between sunrise and sunset; graves may be fenced; tombstones, etc., may be erected and inscriptions must be submitted tj Council: vaults to bo excavated only with leave of Council: same must be constructed in accordance with certain specifications : coffin to be lined with lead or other approved metal; Council may repair neglected vault and charge cost against purchaser ; horses and vehicles excluded fiom Cemetery except for purpose of funerals.
Part XI. Hawkers and Pedlers. Same must be licenced, fonns of application and license, and fees ; license must be carrie 1 ; occupation must be priuted on hand-cart; hawker or pellor not to loiter 01 remain stationary; exemptions under Auctioneers Act, 1908, e|c Part XII. Penalties Same sball not exceed £5 0s Oil for any one offence; no exemption yiveil by these By-laws of compliance with othei By-Laws or General Laws. Atd notice is hereby further given that the said resolution will be submitted for confirmation at the special meeting of the Piauklin County Council to be he'd on THUESDA.Y, the 'Jth day of April, 1914, at the Council Chambers, Pukekohe, at 10.30 a.m., when the date on which the said By-laws will come into force will bo fixed. A full copy of these By-laws is deposited at the office of the Cleik to the said County at the Council Chambers, Pukekohe, and may bo inspected there by all persons during ordinary office hours until the Seventh day of April, 1914. Part 11. Ihe Regulation of Htavy Traffic within the County, Vehicles to bo licensed ; license fee tp be regulated by w eight of vehicle and width of tyres: method of computing weight for stone, gravel, timber, wool, etc; dispensing with license fee in certain cises ; tyre 3 to be of a specified width in certain cases; application for heavy traffic license ; fee to be paid on application, form of application and form of license ; vehicles and licenses to be numbered; prescribing method of numbering vehicles; licenses to expire on 31st December in each year ; powers of Constables and Council officers, to compel inspection of vehicles; drivers to submit their vehicles to inspection; prohibiting the use of bullocks on the County roads from May to October in any year ; safeguarding bridges and culverts, and forbidding certain loads to cross same: exemption of buggies and gigs from operation of heavy' traffic by-laws ; Bond that road will be repaired may be demanded by Council, prescribing terms thereof; penalty not to exceed £'2oo. Part 111. Billiard Rooms, Shooting Galleries and Buildings for Public Meetings must be licensed , prescribing form and fee there-
for of license, same to be in force for one year only: billiards not to be played in licensed premises on Sundays or after 10 p.m., disorderly conduct may entail cancellation of license. Tart IV. Eegulation of Traffic Generally; prescribing lights to 1.0 cairied on vehicles at night, alarms to be carried by certain vehicles. Horses not to stand on roads unattended ; nor to be cleaned or clipped ; drivers to proceed round corners at walking pace; horseless vehicles not to proceed at a greater speed than 20 miles per hour except on Hunua Gorge Road and Tuakau Peach Road where speed not to exceed 5 miles per hour. Provision of Motor Cars Registration Act relating to exhibiting lights and carrying warning signals to apply. Part V. Building*. Definition of "erection of a building"; "site" definition of term ; Provisions for minimum buil.ling ares ; road frontage- to bo not lov*s than 60 feet and aioa not less than J acre in cnss of a dwelling house, or 40 feet and 1 (ith acre in case of a shop; forbidding salo or other disposition of property whereby these provisions are contravened, saving subdivisions already approved ; discretion given to Council to relax or dispense with observance.of By-laws in certain cases provided applicant show merits. Part VI. Cattle. Forbidding passage of saute along any footpath; duty of persons in charge of sa'iie to prevent breach of this regulation ; forbidding any person to rid* l , lead or drive any horte or vehicle along any footpath, saving however where necessary to reach read or for other lawful purpose. Part VII. Special provisions to indemnify the Council for injury to roads arising from carriage of coal, stone, quartz, ore, timber, flax, etc., from any quarry, mine or mill; particulars, as to number of journeys vehicles intended to be used and weight of load, etc., to be supplied to Council seven days before traffic commences ; estimated cost of daniago arising from such traffic to be furnished and same to be paid to Council; further damage arising from continuante of tralfic to bo paid; Statutoiy "lights or rights under any amending By-Law reserved in respect hereof. Part VIII. Passage of Traction Engines oYor County Prescribing necessity for an assistant to travel before engine to warn any person appronching ; duty of driver of engine to stop where required to enable driver of vehicle or stock to pass; no traction engine to travel over County roads between iuu-ot and midnight; prescribing conditions under which same may travel between midnight and sunrise; 10 miles per hour to be maximum | speed on public road and o miles : per hour in town or village and - j miles per hour when crossing a | bridge or culvert; whistle not to be sounded or steam exhausted uuder certain circumstances, driver of traction ongino forbidden to stop ou a bridge or culvort; ashes and other refuse to be npread evenly ou load
