MAGISTRATE'S COURT.
Waiuku—Friday. (Before Mr F. V. Frazer, 8.M.) ABOUT A BOAT. Tony Paitvich v. Hari Hari, claim for building a boat £*. Mr Mason for plaintiff, Mr Haddow for defendant. The Maori defendant claimed that the boat was not built according to directions, in consequence of which he would not take delivery. The Magistrate aaid he was not satisfied with the evidence for the defence and gave judgme.it for the fall amount with costs, £4 17s 6d. STAMP CASES.
A good deal of interest was taken in cases taken by the police, under instructions from the Stamps Department, for breaches of the Stamps Act. The defendants were Alfred Allen (2 cases), J. P. Dromgool, W". E. Kit : on (5 cases). The facts of the case, which were admitted, were that in settling the estate of one Walters, deceased, of Waiuku, it was discovered that it was the custom of deceased when paying money to get the recipients to sign the butt of the cheque book as a receipt without the same being stamped. Mr Hanna, for the defendants, quoted cases which tended to show that the mere fact of signing a name on a cheque-butt was not a receipt within the meaning of the Act.
The Magistrate reserved his decision for further consideration. His Worship intimated that if he derided against Mr Hanna's contention he would, of course, give judgment against the defendants. If. however, Mr Banna's rase appeared sound he would call upon the Stamps Department for their legal argument.
